If you’re wondering if kratom is legal, you’re not alone. 

Depending on where you’re getting your information, you may be concerned that kratom is illegal or kratom is getting outright banned. At the time this guide is written, the answer to both is no. Well, at least here in the United States.

In the U.S., kratom is legal and is not banned, although there’s a select few states that have banned kratom or has a specific law. (we’ll discuss these shortly).

The kratom ban itself, this is a deep topic that has a lot of twist and turns. To put it short and simple, we feel the FDA has special interest from pharmacy payment

It’s not the first time the FDA has been put “front and center.” Now, they’re spreading lies saying kratom kills people.

Here in the United States, kratom is legal in most U.S. states.

WHERE IS KRATOM NOT LEGAL OR BANNED

The following states have banned or are in the process of banning kratom: This is the most current map we could find. These are subject to change.

  • Alabama – Kratom is a Schedule 1 controlled substance drug as of May 10, 2016.
  • Arkansas – Kratom is a controlled substance as of February 2016.
  • California – Kratom is legal except in San Diego where a local ordinance was passed,
  • Florida – Kratom is legal in Florida with the exception of Sarasota County.
  • Illinois – The sale of kratom is banned to minors under the age of 18, it is banned in Jerseyville, but is legal in the state.
  • Indiana – Kratom is classified as a synthetic drug and is banned.
  • New Hampshire – Legal if you are 18 and over.
  • Rhode Island – Kratom is banned in this state
  • Tennessee – Kratom has just been made legal in this state.
  • Vermont – Kratom has been banned in vermont
  • Wisconsin – Kratom is classified as a Schedule 1 and is banned.
